Agreement to Terms

By accessing and using histai.net ("the Website", "the Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our website or services.

Description of Services

histai.net provides the following services:

  • Historical Content: Display of historical events sourced from Wikipedia under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). We provide proper attribution and links to original Wikipedia articles. histai.net is not affiliated with, endorsed by, or sponsored by the Wikimedia Foundation or Wikipedia.
  • User-Submitted Stories: Platform for users to publish their own historical stories (paid service) that are shared publicly across the platform
  • AI Tools: AI-powered tools including (1) Image Generation - create images from text descriptions for historical visualization, (2) Image Restoration - restore and enhance uploaded photos with advanced AI technology, and (3) Age Transformation - transform your appearance to different ages with AI-powered age progression
  • Blog: Original articles and insights about history, technology, and artificial intelligence, owned by histai.net

How do you register an account?

You may browse public content without an account. To use any AI tool, download your generated results, or publish your stories, you must create an account and sign in. When you register, you agree to:

  • Provide accurate, complete, and current information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized access or security breach
  • Be at least 13 years of age (or legal age in your jurisdiction)

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activities.

Free Trial and Paid Services

AI Tools Free Trial

All AI tools require an account and sign-in. Each account receives one free 1K text-to-image generation. Image-to-image generation, photo restoration, age transformation, and higher resolutions require a paid plan. All plans include downloads without added watermarks.

After using your one-time free generation, subscribe to Trial, Pro, or Ultra for monthly credits and higher resolution limits. Credits are included with subscriptions; one-time credit purchases are not available.

Monthly Subscription Plans

  • Trial: US$4.90 per month, 80 credits per billing cycle, image generation up to 4K.
  • Pro: US$9.90 per month, 150 credits per billing cycle, image generation up to 4K.
  • Ultra: US$19.90 per month, 350 credits per billing cycle, image generation up to 4K.

Trial is a paid subscription, distinct from the Free account allowance. All paid plans provide access to image-to-image generation, photo restoration, and age transformation, subject to available credits. Review the recurring charge and applicable taxes at checkout before confirming payment.

Credit Usage

  • Text-to-image: 1 credit per image at 1K or 2K; 2 credits at 4K.
  • Image-to-image: the text-to-image cost for the selected resolution plus 1 credit for each reference image, with a maximum of 3 references. For example, 3 references cost 4 credits at 1K/2K or 5 credits at 4K.
  • Age transformation: 1 credit per task, whether a single image or an age progression GIF.
  • Photo restoration: 3 credits per task.
  • Story publishing: 2 credits per story and an active paid plan.

The tool displays the credit cost before you start. Credits are reserved before the image provider starts a generation task. Failed generations are handled as described under Failed Generation Credits below. Unused subscription credits expire at the end of their validity period regardless of subscription status. Cancelling or buying another subscription does not remove unexpired credits. Each purchase keeps its original expiry date, and credits expiring soonest are spent first. Expired credits are not extended or carried forward. Cancelling renewal does not create a new free allowance.

Publishing Historical Stories

Users with an active paid plan and sufficient credits can publish historical stories for 2 credits per story. By publishing, you understand that:

  • Your story will be publicly displayed across our platform
  • Your story will be accessible to all website visitors
  • Your story may be indexed by search engines
  • You retain ownership of your content but grant us a license to display it (see "User Content License" below)

Payment Terms

For paid services, you agree to:

  • Pay all fees associated with your selected services in United States Dollars (USD)
  • Provide valid and current payment information
  • Authorize us to charge your payment method for all applicable fees
  • Pay any applicable taxes, including but not limited to sales tax, VAT, or other transaction taxes

Subscription payments are processed through Creem. We do not store your full credit card information on our servers. For subscription-based services, fees are charged on a recurring monthly basis until you cancel your subscription. You will be notified via email at least seven (7) days before each automatic renewal.

Subscription Management and Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Upon cancellation:

  • Your cancellation will take effect at the end of your current billing period
  • You will retain access to paid features until the end of the billing period you have already paid for
  • No refund will be provided for the remaining days in your current billing period
  • Automatic renewal charges will cease after the current period expires
  • You can subscribe again while your account remains available; cancelled or expired access does not restore an already-used free allowance

We reserve the right to modify subscription pricing with at least thirty (30) days advance notice to active subscribers. Price changes will take effect at your next billing cycle. You may cancel your subscription before the price change takes effect if you do not agree to the new pricing.

Cancelling renewal does not delete your account or History items. When your subscription expires, your account returns to the Free tier once all paid periods end. Each credit batch expires on its own date, and paid features require a new subscription. An already-used free allowance is not restored. Contact support for account or public-content deletion requests.

Refund Policy

General Policy

Due to the nature of our subscription-based digital services, all payments are generally non-refundable. We strongly encourage users to review all features, pricing, and terms carefully before subscribing. You may cancel your subscription at any time to prevent future charges, but no refunds will be provided for the current billing period already paid.

Right of Withdrawal (EU Customers)

Customers may have statutory withdrawal or refund rights, including a fourteen-day withdrawal period where EU consumer law applies. Exceptions for digital content or services depend on the applicable law and any required express consent and acknowledgment. Using credits does not by itself waive rights that cannot lawfully be waived. Contact [email protected] to request review of your purchase.

Failed Generation Credits

If a generation fails without delivering an approved result, its credits return to the original unexpired batches without extending their expiry dates, or the free attempt used for it is restored. Restoring a failed free attempt is not a recurring allowance. If the return cannot be confirmed, use the retry option or contact support. This is an account credit adjustment, not a refund of the subscription payment. Successfully delivered results are not automatically eligible for a credit return.

Technical Issues and Service Failures

We may provide refunds on a case-by-case basis for documented technical issues or service failures that we cannot resolve within a reasonable timeframe. Refund requests due to technical issues must be submitted to [email protected] with detailed information about the problem encountered.

Non-Refundable Items

The following are explicitly non-refundable:

  • Subscription fees for time already elapsed in the current billing period
  • Credits used for successfully delivered results or completed publishing, except where applicable law requires otherwise
  • Published historical stories and events
  • Downloaded AI-generated content that has been accessed or saved

Refund Request Process

All refund requests must be submitted in writing to [email protected] within fourteen (14) days of the transaction date (for EU customers exercising withdrawal rights) or within seven (7) days of experiencing a technical issue. Approved refunds will be processed within fourteen (14) business days to your original payment method.

Content Safety and NSFW Restrictions

HistAI is not an adult-content service. These rules apply to prompts, reference photos, restoration and age-transformation uploads, generated results, and public stories. Free and paid accounts follow the same rules.

  • Do not request, upload, generate, or publish pornography, sexually explicit imagery, or sexualized nudity.
  • Sexual content involving minors, or anyone depicted as a minor, is prohibited. Do not use age transformation to create sexualized depictions of children.
  • Do not create non-consensual intimate imagery, sexual exploitation, or abusive impersonations of real people.
  • Do not submit content that promotes violence, hate, harassment, or self-harm, or otherwise violates applicable law or another person's rights.
  • Do not bypass content checks, disguise prohibited requests, or repeatedly resubmit blocked content to evade restrictions.

How Automated Checks Work

We use automated third-party moderation to check text prompts and uploaded images before generation, and generated images before saving an approved result to History or making it available for download. New or edited story titles, descriptions, and uploaded images are also checked. Text checks include sexual content, sexual content involving minors, violence, hate, harassment, and self-harm; image checks assess NSFW and other safety signals. Generation providers may apply additional restrictions.

Automated checks can make mistakes and may not identify every issue. Existing content and comments are not all retrospectively screened. Passing a check is not a guarantee that content is safe, accurate, lawful, or suitable for publication; you remain responsible for your use. Historical, artistic, or educational context does not guarantee approval.

Blocked Requests, Credits, and Review

Inputs rejected before generation do not consume generation credits or the free attempt. If a generated result is rejected, or its safety check cannot be completed, it is withheld and the failed-generation credit return process applies. When moderation is unavailable, processing stops rather than bypassing checks. A credit return is confirmed only after it succeeds; use Retry refund if confirmation is pending.

If you believe a decision is mistaken or want to report harmful content, contact [email protected] with the task identifier or relevant page link. Do not email prohibited imagery. We can investigate reports, but cannot guarantee that a provider decision will be reversed. Abuse may lead to content removal, restricted access, or account suspension under these Terms.

User-Generated Content

Your Content Responsibilities

When you submit historical stories or other content to histai.net, you represent and warrant that:

  • You own or have the necessary rights to the content
  • The content does not violate any laws or third-party rights
  • The content does not contain false, misleading, or defamatory information
  • The content does not contain offensive, hateful, or inappropriate material
  • The content does not infringe copyright, trademark, or other intellectual property rights

Content License to histai.net

For stories and other content you choose to publish publicly on histai.net, you grant us a worldwide, non-exclusive, royalty-free license for the duration that your content remains on our platform to:

  • Display, reproduce, and distribute your content across our platform
  • Make your content publicly accessible to all users
  • Create derivative works for formatting, optimization, and display purposes
  • For promotional uses beyond displaying your published content on the platform, seek your separate permission

Uploading a photo to an AI tool does not by itself authorize public publication or promotional use. You retain ownership of your original content. You can delete your own stories through the available story management controls or contact [email protected] for help with removal. Search engines, web archives, and other parties may retain copies beyond our control. The license granted to us terminates upon content removal, except for archival copies retained for legal compliance purposes.

Content Moderation

We reserve the right to review, edit, or remove any user-submitted content that violates these terms, is inappropriate, or infringes on third-party rights. We may do so without prior notice.

Uploaded Photos and Reference Images

When you upload images for image-to-image generation, restoration, or age transformation, you represent and warrant that:

  • You own the rights to the uploaded images or have obtained necessary permissions from the rights holder
  • The uploaded images do not violate any laws, third-party rights, or contain illegal content
  • The uploaded images do not contain offensive, hateful, or inappropriate material
  • You have any permissions required to process identifiable people in the images, including appropriate permission when uploading a child's photo
  • You understand that images are processed by third-party generation and moderation providers as described in our Privacy Policy

Data Processing and Storage: Uploaded inputs and sampled animation frames use temporary storage and scheduled lifecycle cleanup. They are not necessarily deleted immediately after processing or rejection. Approved results are saved to your account History. Our Privacy Policy explains storage, third-party processing, retention, and deletion requests.

Rights and Ownership: You retain all ownership rights to your original uploaded images. Generated, restored, and age-transformed images are treated as AI-generated content, and ownership rights are subject to the same terms described in the "AI-Generated Content" section below.

AI-Generated Content

Our AI creation tools generate images and age progression GIFs based on your inputs. You acknowledge that:

  • AI-generated content is created for creative, educational, and personal purposes
  • AI-generated content may not be historically accurate or factual and should not be relied upon as authoritative
  • Age transformations are creative simulations, not predictions of appearance or medical assessments
  • You are responsible for reviewing and verifying AI-generated content before use
  • We do not guarantee the accuracy, quality, suitability, or appropriateness of AI-generated materials
  • You may use downloaded AI-generated content for personal, educational, and non-commercial purposes
  • Commercial use of AI-generated content may be subject to additional licensing terms and fees

Ownership and Rights: Ownership and intellectual property rights in AI-generated content are subject to the policies of our third-party AI service providers. To the extent permitted by applicable law and our agreements with AI providers, you receive a limited, non-exclusive license to use AI-generated content that you have created through our platform. We make no representations regarding the copyright status of AI-generated works, which remains an evolving area of law. You agree to comply with all applicable laws and regulations regarding the use of AI-generated content.

Intellectual Property Rights

Wikipedia Content Attribution

Historical events displayed on our homepage are sourced from Wikipedia, the free encyclopedia, and are used in accordance with the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0).

In compliance with Wikipedia's licensing requirements, we:

  • Provide clear attribution to Wikipedia as the original source
  • Include direct hyperlinks to the original Wikipedia articles for each historical event
  • Indicate that the content is available under CC BY-SA 4.0 license
  • Make no claim of ownership over Wikipedia-sourced content
  • Do not impose additional restrictions on content derived from Wikipedia

Prohibited Activities

  • Impersonate any person or entity or misrepresent your affiliation
  • Submit false, misleading, or fraudulent information
  • Upload malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to our systems or user accounts
  • Use automated tools to scrape, copy, or extract large amounts of data
  • Interfere with or disrupt the service or servers
  • Harass, abuse, threaten, or harm other users
  • Submit content that infringes intellectual property rights
  • Share or distribute offensive, hateful, or inappropriate content
  • Circumvent payment systems or abuse free trials
  • Resell or commercially exploit our services without authorization

Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms of Service
  • Engage in fraudulent, abusive, or illegal activities
  • Submit inappropriate or infringing content
  • Fail to pay for services
  • Compromise the security or integrity of the service

You may request account deletion by contacting [email protected]. Subscription cancellation is available separately from the account dashboard. Deleting a History item or a public story does not cancel a subscription. Upon account termination, access to paid features ceases. Public-content removal is handled as described in the "User-Generated Content" section and our Privacy Policy.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, shortages of transportation, facilities, fuel, energy, labor or materials, failure of third-party service providers (including hosting, payment, or AI service providers), or any other event beyond our reasonable control. During such events, our obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to minimize the impact and resume normal operations as soon as practicable.

  • Accuracy, completeness, reliability, or currency of content (historical events from Wikipedia, user-submitted stories, AI-generated materials)

  • Fitness for a particular purpose or non-infringement
  • Results obtained from using the service or accuracy of materials downloaded

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. This includes but is not limited to features, functionality, content, pricing, and technical specifications.

For significant changes affecting paid services (including pricing modifications or removal of major features), we will provide at least thirty (30) days advance notice to active subscribers via email. If you do not agree with the modifications, you may cancel your subscription before the changes take effect, and you will retain access until the end of your current billing period.

Changes to Terms

We may revise these Terms of Service at any time. Material changes will be communicated through email or a prominent notice on the website. Your continued use of histai.net after changes take effect constitutes acceptance of the modified terms.

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with applicable international commercial laws and principles. Any disputes arising from these terms or your use of the service shall be resolved in good faith through negotiation between the parties.

If negotiation fails to resolve a dispute within thirty (30) days, either party may pursue resolution through appropriate legal channels. Nothing in these Terms shall limit either party's right to seek injunctive relief or other equitable remedies in a court of competent jurisdiction.

Certain jurisdictions may provide additional consumer rights that cannot be waived by agreement. Nothing in these Terms limits any such mandatory consumer protection rights under applicable law.

Entire Agreement
